Delivery Terms and Conditions
Contract
We require 50% deposit of the total order, payable at the time of placing the order.
We then contact you as the goods arrive into our warehouse and we request that payment is received, in full, before we can deliver them.
If, at the time of the ordered goods arriving at our warehouse, you are unable to take delivery, we still require payment in full.
Our acceptance of your order brings into existence a legally binding contract between us.
Storage
We prefer not to in all cases but appreciate that, under certain circumstances goods may need to be stored for a short period of time before delivery. We can store goods once paid for in full, for up to 14days inclusive, and thereafter, depending on the volume of goods to be stored and for how long we will agree with the customer an amount to be charged for storage. Alternatively they can be delivered to a local storage facility, of your choosing but that upon the delivery of the goods ordered to such a facility, the goods are no longer our responsibility.
If the storage facility is out of town (ie: NOT an FY postcode), then a further delivery charge will be incurred.
Price
All prices are in pounds sterling
All purchases within the UK are charged VAT at 17.5%.
Delivery
We will endeavor to deliver the goods that you have purchased, as soon as possible, after the payment in full has been received.
You should inform us at the time of ordering the goods, of any circumstances that may hinder the delivery of the ordered item/s. If at the time of delivery, there is any reason, as to why we cannot access a building or gain access to a particular area of a building and an alternative solution is required to deliver the item we can and will not be held responsible for any further costs.
Events beyond our control
We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
Invalidity
If any part of these Terms & Conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
Third party rights
Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement, but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
Governing law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
Entire agreement
Together with our current website prices, delivery details, contact details and Privacy Policy, these Terms & Conditions set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorized representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
